    By accessing or using heydayfocus.com (the "Site"), operated by Heyday Focus ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately stop using the Site.

    These Terms apply to all visitors, users, and others who access or interact with the Site in any way.

    2. Description of the Service

    Heyday Focus operates an online directory of applications, tools, and services intended to help individuals manage attention, productivity, and ADHD-related challenges.

    The Site provides information about third-party products. Unless explicitly stated otherwise, Heyday Focus does not own, operate, develop, or control any of the listed applications or services. Listing on the Site does not imply any partnership, endorsement, or affiliation between Heyday Focus and the listed product or its developer.

    All content on the Site is provided strictly for informational and educational purposes.

    The Site does not provide medical, psychological, therapeutic, or any other form of professional health advice. Nothing on the Site should be construed as a diagnosis, treatment recommendation, or substitute for professional medical or mental health care.

    Inclusion of any app, tool, or service in the directory does not constitute an endorsement, recommendation, or guarantee of its safety, effectiveness, or suitability for any individual.

    The Site contains links to third-party websites, products, and services that are not owned or controlled by Heyday Focus. We provide these links solely for your convenience and reference.

    Heyday Focus is not responsible for:

    • The content, accuracy, or opinions expressed on third-party sites
    • The privacy practices or data collection of third-party services
    • The functionality, availability, security, or performance of any third-party product
    • Any loss, damage, or harm resulting from your use of third-party products or services

    All original content on the Site, including but not limited to website design, text, editorial content, graphics, logos, icons, and the selection, arrangement, and organization of directory data, is the property of Heyday Focus and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

    You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise reuse any Site content without our prior written permission, except as permitted by applicable law.

    Logos, product names, and trademarks of listed apps and services belong to their respective owners. Their appearance on the Site does not grant you any license or right to use them.

    8. User Submissions

    If you submit information to the Site, including app listings, corrections, suggestions, reviews, or feedback, you grant Heyday Focus a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display that content in connection with operating and improving the Site.

    By submitting content, you represent and warrant that:

    • The submitted content is accurate to the best of your knowledge
    • You have the right to grant the license described above
    • The content does not infringe any third party's intellectual property or other rights
    • The content does not contain unlawful, defamatory, or misleading material

    We reserve the right to remove or modify any user-submitted content at our sole discretion.

    9. Acceptable Use

    You agree not to use the Site in any way that:

    Heyday Focus does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

    12. Limitation of Liability

    To the fullest extent permitted by applicable law, Heyday Focus, its owners, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

    • Your access to or use of (or inability to access or use) the Site
    • Any reliance on information provided in the directory
    • Your use of any third-party products or services listed on or linked from the Site
    • Any errors, omissions, or inaccuracies in Site content
    • Any unauthorized access to or use of our servers or any personal information stored therein

    In no event shall our total liability to you exceed one hundred Canadian dollars (CAD $100.00).

    13. Indemnification

    You agree to indemnify, defend, and hold harmless Heyday Focus and its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:

    • Your use of the Site
    • Your violation of these Terms
    • Your violation of any third party's rights
    • Any content you submit to the Site

    14. Changes to the Site

    We reserve the right to modify, suspend, or discontinue any part of the Site at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.

    15. Changes to These Terms

    We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

    16. Dispute Resolution

    In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site, you agree to first attempt to resolve the dispute informally by contacting us at hello@heydayfocus.com. We will attempt to resolve any dispute within thirty (30) days of receiving notice.

    If a dispute cannot be resolved informally, the parties agree to submit to binding arbitration administered in accordance with the laws of Ontario, Canada. Any arbitration shall take place in Ontario, Canada, and shall be conducted in English.

    You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action.

    17. Severability

    If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

    18. Waiver

    No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

    19. Entire Agreement

    These Terms, together with our Privacy Policy and any other legal notices or policies published on the Site, constitute the entire agreement between you and Heyday Focus with respect to your use of the Site and supersede all prior agreements, understandings, and communications.

    20. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to the dispute resolution provisions above, the courts of Ontario, Canada shall have exclusive jurisdiction over any disputes arising under these Terms.

    21. Age Requirement

    The Site is intended for users who are at least 13 years of age. If you are under 13, you may not use the Site. If you are between 13 and the age of majority in your jurisdiction, you may only use the Site with the consent of a parent or legal guardian.
